What is Judicial Review?

Judicial Review is a legal process where the Federal Court of Canada reviews decisions made by government authorities—such as immigration officers, tribunals, or other administrative bodies—to determine whether they acted fairly, legally, and within their authority.

Unlike an appeal, a judicial review does not re-evaluate facts or evidence. Instead, it focuses on whether the process was fair and the law was applied correctly. If successful, the court can set aside the decision and send it back for reconsideration, giving you another chance at justice.
